Recommendation:
It is recommended that the Town Council adopt the attached Resolution No. 2176.11 as presented.
Background:
As part of the Capital Improvement Projects, one element is the undergrounding of the Town’s overhead utilities. We have been working with Florida Power and Light (FPL) as they designed and we coordinated the installation of the underground facilities and the eventual removal of the existing overhead facilities.
During this time, we have operated under the following premises:
- FPL would design and engineer the underground utilities in coordination with C3TS
- The Town (through Southeast Engineering, Inc.) CIP would install the underground facilities
- FPL would be responsible for the removal of the overhead utilities
The attached documents are required as the Town desires to enter into a relationship with FPL that safeguards the residents of the Town while sharing the financial obligations of converting the Towns overhead utilities to an underground system. The agreement and/or document titled Underground Facilities Conversion Agreement – Governmental Adjustment Factor Waiver constitutes the Agreement. This is the fourth of a series of agreements.
Fiscal Impact:
The conversion is budgeted at $3.6 million dollars, this agreement calls for a payment of $271,356.00 associated with phase 4 of the conversion sequencing. This is the final agreement required to complete the FPL portion of the undergrounding.
