7:00 P.M.

MEETING CALLED TO ORDER
Mayor Singer called the meeting to order at 7:10 p.m. Roll Call taken by Town Manager.

Council Members in attendance:  Mayor Singer, Councilmember Colella-Battista, and Councilmember Lusskin.  

Staff in attendance:  Town Manager, Chief Skinner, Maria Camacho, Town Attorney Helfman, Dan Nieda, and Barbara Tarasenko.

Consideration of the following ordinances:

ORDINANCE NO. 510.06

AN ORDINANCE OF THE TOWN OF GOLDEN BEACH, FLORIDA, AMENDING Section 66-140 “Setback areas–Generally” of Article IV “Supplementary District Regulations” of Chapter 66 “Zoning” OF THE TOWN OF GOLDEN BEACH CODE OF ORDINANCES, REVISING THE PERMITTED ELEVATION OF STRUCTURES IN SETBACK AREAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE.

Town Manager read the title of the Ordinance into the record.  

Dan Nieda gave an update on the Ordinance and explained the purpose of the amendment.

Attorney Helfman explained the purposes of the Local Planning Agency and how they make the recommendation that affect the Town's Comprehensive Plan.

Council comments - none

Mayor opened the public hearing.

No one spoke.  

Mayor closed the public hearing.

Motion made to recommend this Ordinance as it is consistent with the Town's Comprehensive Plan and to recommend it's adoption by Councilmember Lusskin. Seconded by Councilmember Colella-Battista.  Consensus vote was taken - 3 Ayes, 0 Nayes.

ORDINANCE NO.  511.06
AN ORDINANCE OF THE TOWN OF GOLDEN BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES BY ESTABLISHING SECTION 50-11, “DEMOLITION OF STRUCTURES”, OF CHAPTER 50 “BUILDINGS AND BUILDING REGULATIONS” PROVIDING FOR RULES AND PROCEDURES REGULATING THE DEMOLITION OF BUILDINGS AND STRUCTURES WITHIN THE TOWN; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.

Town Manager read the title of the Ordinance into the record.  

Dan Nieda gave an update on the Ordinance and explained the purpose of the amendment was to clear up the demolition permits and requires a re-vegetation bond, and sets time limits.

Council comments:
Councilmember Colella-Battista - no comments

Councilmember Lusskin question Item D - would it require the builder to build a retainer wall.  Dan explained the review process for water retention.  She also noted the written estimate by a landscape architect.  Dan clarified the requirement.

Motion made to recommend this Ordinance as it is consistent with the Town's Comprehensive Plan and to recommend it's adoption by Councilmember Colella- Battista. Seconded by Councilmember Lusskin.  Consensus vote was taken - 3 Ayes, 0 Nayes.


ORDINANCE NO. 512.06

AN ORDINANCE OF THE TOWN OF GOLDEN BEACH, FLORIDA, AMENDING Section 66-102 “Minimum lot and swale elevations; grade” of Article IV “Supplementary District Regulations” of Chapter 66 “Zoning” OF THE TOWN OF GOLDEN BEACH CODE OF ORDINANCES, REVISING ELEVATION REQUIREMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE.

Town Manager read the title of the Ordinance into the record.  

Council comments:

Mayor questioned why we do not address asphalt driveways.  Dan explained the advantage of pavers as enhancing drainage.  Attorney Helfman explained that we were only changing Section A.  Town Manager explained the gravel driveways were grandfathered in.  Mayor asked that the Town Attorney look at the grandfathering in section of the Code that guarantees they are grandfathered.  

Councilmember Colella-Battista - questioned by the Town does not allow grandfathering.

Councilmember Iglesias entered meeting.

Mayor opened the public hearing.

No one spoke.  

Mayor closed the public hearing.

Motion made to recommend this Ordinance as it is consistent with the Town's Comprehensive Plan and to recommend it's adoption by Councilmember Lusskin. Seconded by Mayor Singer.  Consensus vote was taken - 4Ayes, 0 Nayes.

Motion to adjourn by Councilmember Colella-Battista. Seconded by Councilmember Lusskin.
Vote: All in favor - No one opposed.
